There have been some recent changes in the demand for Martha Hart against WWE, Vince McMahon and Linda McMahon as part of what is still in court.
On November 16, Judge Stefan R. Underhill dismissed a part of the demand for Hart against WWE. Remains to be seen what had actually rejected and what was left, but it seems that the WWE continues to gradually charges brought against them by the widow of Owen Hart.
Before the hearing of November 16, the remains were complaints when using Owen's name, because according Hart WWE has no rights to use, market and promote that name in its materials and DVDs not being considered a "ring name".
The complaint also maintained that the WWE released eight DVDs and other materials including WWE Encyclopedia without adequate payments to goods of Owen by its contract with Titan Sports, which required royalty payments after his death.
Then there are the claims that the WWE has used original intellectual property, including family photos, without the consent of the family of Owen.
On November 27, a partial judge approved a motion to dismiss the claim of personal demand for copyright infringement against Vince Hart.
Judge Underhill ruled that there was insufficient evidence to accuse McMahon for copyright infringement.
The judge noted that to establish liability in a lawsuit for copyright infringement, the family of Hart would have to prove that Vince had. The only evidence that Hart had was that Vince is the WWE Chairman and the largest shareholder, but that was not enough to charge him.
It is worth noting that Linda is not mentioned in any of the recent decisions, so they are still in process.
Vince and Linda had asked Hart's lawyers should pay the legal costs of the WWE, but the court denied it.
Likewise, the court refused to remove certain comments made in the latest amended lawsuit against WWE and the McMahons.
